SEM 6 - CONSTRUCTION LAW

Construction law is very similar to Professional Practice in nature, but it is more complicated and in-depth to construction knowledge. 
 
Besides PAM Form, we managed to learn alot about other contracts like FIDIC and acts like CIPAA. 
This module has taught me to understand the basic principle of construction law, the importance of adhering to the specific procedures and emphasis on notices. I also develop an in-depth knowledge on the application of the law and the remedies available to the parties. Subsequently, the assignments given requires us to analyze disputes and the respective liabilities. By the end of the semester, I am more aware of matters involving contractual claims as well as how to assess them. This is especially important when I go out to work in the future as I would have to assess many contractual matters. 
 
For the group presentation, I was teamed with three other members and we were required to present on Remedies on Breach. This topic is particularly interesting and my part requires me to explain on "Quantum Meruit" which is latin for as much as he deserves.

In addition, we were given the second assignment which requires us to assess a Contractor's claim due to employer's termination. We have to assess the applications based on the conditions of contract and principles of laws relating to remedies and damages due to breach of contract. Upon completion of this subject, I am able to identify, explain and distinguish the various laws related to the construction industry including land law and construction statutes by demonstrating knowledge and understanding of the principles in law, conditions of contract and the applicable statutes.
Besides that I can now apply this knowledge on the principles of law in administration of contracts and contractual claims including providing evidence of reasoned advice in relation to contractual claims and interpretation of any discrepancies of various contract documents. In addition, I learn to take appropriate methods of dispute resolution for different situations arising from construction contract.
